The Let Me Know App is owned by THE TRUSTEE FOR THE LET ME KNOW FOUNDATION ABN 99 607 918 078 (“Let Me Know”). Please read the following terms and conditions (“Terms of Use”) carefully as they govern your use of the Let Me Know App and any associated website (“Let Me Know App”). In these Terms of Use, “you” “your” or “user” refers to any user of the Let Me Know App, regardless of how the Let Me Know App has been accessed. By downloading or otherwise using or accessing the Let Me Know App, you agree to these Terms of Use and associated Privacy Collection Statement and Privacy Policy. If you do not agree with these Terms of Use, Privacy Collection Statement or Privacy Policy, you should not proceed to use the Let Me Know App.

1. PURPOSE OF THE LET ME KNOW APP

The Let Me Know App is designed to help you to keep track of your mental wellbeing in the course of undertaking your duties as a valued member of the Melbourne Metropolitan Fire Brigade (“MFB”), and Victorian Country Fire Authority (“CFA”).

Developed by senior clinical specialist researchers in posttraumatic mental health and psychiatry, in conjunction with beyondblue and upon the financial support and assistance of the MFB, the Let Me Know App is a confidential, password-protected tool for members of the MFB and CFA that enables you to measure and monitor your mental health and wellbeing as a result of exposures to incidents and daily events and associated stresses.

The Let Me Know App allows you to graphically track how you’re travelling. The Let Me Know App will assess your responses to questions or prompts provided to you and if certain ratings or accumulative scores are reached as a result of your answers, the Let Me Know App will prompt you to connect with support networks or to seek further help by requesting a support person to contact you.

The Let Me Know App also provides general wellbeing and mental health information, including about sleep, fitness, nutrition health conditions and mindfulness, to assist in educating you of the importance of these elements in improving mental health and resilience.

2. NO RELIANCE ON ACCURACY

While Let Me Know endeavours to provide users of the Let Me Know App with accurate and helpful information, the Let Me Know App is not intended to be a substitute for professional medical advice, diagnosis or treatment. Diagnosis and treatment of a clinical condition can only be undertaken by a qualified health professional. You should seek the advice of an appropriately qualified healthcare professional before making decisions about your own circumstances or relying on anything contained in the Let Me Know App. The Let Me Know App is provided for informational purposes only. You should not disregard professional medical advice, or delay seeking it, because of any information contained on the Let Me Know App.

Let Me Know regularly reviews the information on our App, however we cannot guarantee that all of the information is accurate.

3. SELF-ASSESSMENT TOOLS AND SURVEYS

Users of the Let Me Know App should always seek the advice of a qualified health professional with any questions or concerns they have regarding their health or a medical condition. Let Me Know does not guarantee the accuracy, quality, suitability or reliability of any information on this App

The self-assessment tools and surveys provided on this App are not intended to be a substitute for professional clinical advice. While the results of the self-assessment tools and surveys may be of assistance to you, users should always seek the advice of a qualified health provider with any questions they have regarding their health. Let Me Know does not guarantee the accuracy, quality, suitability or reliability of any information on this App, or that the self-assessment tool or any results they produce are correct, complete, reliable or appropriate for your individual circumstances.

4. PROMPTS TO SEEK SUPPORT AND REQUESTING CALL BACKS.

The Let Me Know App has been developed by clinical specialists. Any prompts to the user to seek help and support are a recommendation only. Let Me Know cannot make any guarantee of timeliness or accuracy of any prompts, or that a user would otherwise be advised to seek professional help or support regardless of the instance of a prompt.

Where you request a call back, Let Me Know will use all reasonable endeavours to ensure you are contacted by a support person as soon as possible. Let Me Know makes no guarantee as to the timeliness of any such call back. You acknowledge that any support person(s) provided to you in the course of your use of the Let Me Know App (whether as result of your request for a call back, or otherwise), may not be medically or clinically trained and may not have clinical or diagnostic expertise. You further acknowledge that the assistance of any support person provided to you in the course of your use of the Let Me Know App (whether as result of your request for a call back, or otherwise), is not intended to be a substitute for professional clinical advice.

You and your related entities, successors and assigns agree to indemnify and hold harmless Let Me Know, its officers, employees, agents, contractors, volunteers and consultants from and against all actions, claims, proceedings, or demands (including those brought by third parties) which may be brought against it or them, whether on their own or jointly with you in respect of any loss, death, injury, illness, damages, costs or expense directly or indirectly related to your use of the Let Me Know App.

5. COMPLIANCE AND STANDARDS

The Let Me Know App also has its own internal quality assurance standards for the App (covering tone and style of language, accuracy, attribution and verification of sources and links among other things).

6. GENERAL DISCLAIMER

To the extent permitted by law, Let Me Know will in no way be liable to you or anyone else for any loss or damage, however caused (and whether direct, indirect, consequential or economic) which may be directly or indirectly suffered in connection with use of the Let Me Know App or apps or websites of other entities which are hyperlinked from the Let Me Know App (“Linked Websites”).

This general disclaimer is not restricted or modified by any other specific warnings and disclaimers contained in these Terms of Use.

7. SPECIFIC WARNINGS AND DISCLAIMERS

The information contained on the Let Me Know App is provided by us in good faith and on an 'as is' basis. The information is believed to be accurate and current as at the date the information was placed on the Let Me Know App.

We make no representation or warranty as to the reliability, accuracy or completeness of the information contained on the Let Me Know App, or that your use of the Let Me Know App will be uninterrupted or error free, or appropriate for your individual circumstances.

You should not act on the basis of anything contained on the Let Me Know App without first obtaining professional advice specific to your individual circumstances. Never disregard professional mental health assistance or medical advice or delay in seeking treatment because of something you have seen on the Let Me Know App. You must make your own assessment of the information contained on the Let Me Know App and, if you choose to rely on it, it is wholly at your own risk.

We are not liable to you or anyone else if interference with or damage to your mobile phone, tablet, computer system or other device occurs in connection with your use of the Let Me Know App or a Linked Website. You must take your own precautions to ensure that whatever you select for your use from the Let Me Know App is free of viruses or anything else (such as worms or trojan horses) that may interfere with or damage the operations of your computer systems or other devices.

We may, from time to time, change or add to the Let Me Know App without notice. However, we do not undertake to keep the Let Me Know App updated and we will not be liable to you or anyone else if errors occur in the information on the Let Me Know App or if that information is not up-to-date.

To the extent permitted by applicable law, all implied conditions, representations, warranties and other terms are excluded. You must ensure that your access to the Let Me Know App is not illegal or prohibited by laws which apply to you or in your location.

8. YOUR USE OF THE LET ME KNOW APP

As a condition of your use of the Let Me Know App, you warrant to us that you will not use the Let Me Know App for any purpose that prohibited by these Terms of Use, or under general law. In particular, you agree not to:

  • use the Let Me Know App for any illegal purpose;
  • use the Let Me Know App to defame, abuse, harass, stalk, threaten or otherwise offend any person;
  • publish, distribute, email, transmit or disseminate any material which is unlawful, obscene, defamatory, indecent, offensive or inappropriate;
  • use any automated scripting tools or software;
  • engage in or promote any third-party surveys, contests, pyramid schemes, chain letters, unsolicited emailing or spamming via the Let Me Know App;
  • impersonate any other person or entity;
  • share information which reasonably identifies another person without their consent (if you do share personal information about another person, please let them know about our Privacy Collection Statement and Privacy Policy which sets out how we will handle their personal information);
  • upload, post, email, transmit or otherwise make available using the Let Me Know App any material that you do not have a right to make available or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware or to utilise other computer systems for improper purposes or without authorisation; or
  • breach any laws or regulations which are applicable to your use of the Let Me Know App in your jurisdiction.

You are provided with access to the Let Me Know App and may download, store in cache, display, print or make a single copy of the information or material stored on the Let Me Know App (in its unaltered form) and for your personal and non-commercial use only.

Except for these purposes, and for the purposes of and subject to the conditions prescribed under the Copyright Act 1968 (Cth) (or any similar statute that applies in your jurisdiction), you may not, in any form or by any means:

  • adapt, reproduce, store, distribute, transmit, print, display, perform, publish or create derivative works from any part of the Let Me Know App; or
  • commercialise any information, products or services obtained from any part of the Let Me Know App, without our written permission.

10. TRADE MARKS

All trade names, trademarks, service marks and other product and service names and logos (“Marks”) displayed on the Let Me Know App are proprietary to their respective owners and are protected by applicable trade mark and copyright laws. These Marks may be our registered or unregistered Marks or may belong to others and are used on the Let Me Know App with permission of the relevant owner.

Nothing contained on the Let Me Know App should be construed as granting any licence or right of use of any Mark which is displayed on the Let Me Know App without the express written permission of the relevant owner.

If you use any of our Marks to refer to our activities, products or services, you must include a statement attributing that Mark to us. You must not use any of our Marks:

  • in or as the whole or part of your own Marks;
  • in connection with activities, products or services which are not ours;
  • in a manner which may be confusing, misleading or deceptive; or
  • in a manner that disparages us or our information, products or services (including the Let Me Know App).

11. LINKED WEBSITES

the Let Me Know App may contain links to Linked Websites. Those links are provided for convenience only and may not remain current or be maintained. We have no control over or rights in any Linked Website that is not our own.

The inclusion of a Linked Website should not be construed as any endorsement, approval, recommendation or preference by us of the owners or operators of the Linked Website, or for any information, product or service referred to on the Linked Website.

Your use of any Linked Website is entirely at your own risk and you will be bound by the terms and conditions (if any) posted on the Linked Website and not by these Terms of Use.

We are not responsible for the privacy practices of any third party social media or other service providers that you can access through the Let Me Know App.

12. STORED DATA (COOKIES)

We use cookies (small data files that are stored on your device) to collect anonymous traffic data and to improve your user experience. You can remove or block cookies using the settings in your web browser, but this may impact your ability to use the Let Me Know App.

We may also collect and store information about your visit to the Let Me Know App, including:

  • the name of the domain from which you accessed the internet;
  • the date and time you accessed the Let Me Know App;
  • the internet address of the website from which you linked directly to the Let Me Know App;
  • the pages you accessed while visiting the Let Me Know App;
  • the type of device from which you accessed the Let Me Know App; and
  • the location (to closest major city) from which you accessed the Let Me Know App.

All of the information we collect is aggregated and cannot be used to identify you individually. This information is used to measure visitor numbers and to assess how the Website was used in order to maintain its effectiveness.

We do not collect this information for any type of online advertising.

13. SOCIAL MEDIA

We have a number of social media accounts, which currently includes Facebook, Twitter, YouTube, Instagram and LinkedIn (collectively known as our Pages). All content on our Pages is subject to individual terms of use as outlined by each social media provider.

By interacting with our Pages, you agree to be bound by the terms of use of the relevant social media provider.

14. GENERAL

We may change these Terms of Use at any time without notice. Any amendment will be effective immediately. Your continued use of the Let Me Know App after any amendment constitutes an agreement by you to comply with, and be bound by, the amended Terms of Use. Accordingly, you should access and read the Terms of Use from time to time for changes.

These Terms of Use are governed by the laws in force in Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms of Use or the Let Me Know App.
